The U.S. Consumer Product Safety Commission (CPSC) has released updated guidance regarding the Harmonized Tariff Schedule (HTS) codes that have been flagged in U.S. Customs and Border Protection's Automated Commercial Environment (ACE) since July 8, 2026.
The revised guidance includes approximately 600 HTS codes that CPSC has identified as likely to contain products subject to mandatory safety standards or otherwise considered higher risk. One of the most significant updates is the document’s new organization by CPSC-designated flag type (CP1 or CP2) for each HTS code.
This format is intended to provide greater clarity to the trade community by indicating when eFiling data may be required and when it is required based on the associated HTS classification.
In addition to the updated structure, CPSC has modified or removed the flag designation for a limited number of HTS codes. Details regarding these changes can be found in the document's "Change Log" tab. Importers should note that this list is not exhaustive and does not include every HTS code that may contain products requiring an electronic Certificate of Compliance (CoC).
When an eFiled certificate is required, responsibility for submission remains with the importer of record.
